Acceptance of Terms
By accessing our website, requesting a quote, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Client") and Infodots Services LLP ("Company", "we", "us", "our").
If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not agree with these terms, please do not use our services.
Services We Provide
NYC Website Designs provides professional web design, development, and related digital services to businesses in New York City and beyond. Our services include but are not limited to:
The specific scope of work, deliverables, timeline, and pricing will be outlined in a project proposal or agreement provided to you before work commences.
Payment Terms
Standard Payment: 60/40 Split
60% deposit is required to secure your project slot and begin work. The remaining 40% is due upon project completion, before final delivery and launch.
Priority Timeline: 100% Upfront
For expedited or priority projects, 100% payment upfront is required. This guarantees immediate scheduling and fastest possible delivery.
Initial deposit must be received before any design or development work begins.
We accept ACH bank transfer only. Credit/debit cards are not accepted at this time.
Your project will be scheduled and work will begin within 2-3 business days of deposit confirmation.
All prices are quoted in USD and are subject to applicable taxes where required by law.
No Refund Policy
All payments are final and non-refundable. Once payment has been made and work has commenced, no refunds will be issued under any circumstances. This policy exists because:
- •Design and development work involves significant time, resources, and creative effort that cannot be reclaimed.
- •Project slots are limited, and your booking prevents us from taking on other clients.
- •Custom work is created specifically for your business and cannot be resold or reused.
By making a payment, you acknowledge and accept this no-refund policy. We strongly encourage you to review our portfolio, read testimonials, and ask any questions before proceeding with your order.
Project Cancellation
If you wish to cancel your project after payment has been made:
- •No refund will be provided as per our no-refund policy.
- •Any work completed up to the cancellation date will be provided to you.
- •Source files and assets may be released upon request.
- •Hosting and domain services included in the package will be terminated.
Client Responsibilities
To ensure timely delivery and successful completion of your project, clients agree to:
Provide Content
Supply all necessary text, images, logos, and materials within the agreed timeframe.
Timely Feedback
Review and provide feedback on designs and deliverables within 5 business days.
Accurate Information
Ensure all provided information is accurate and does not infringe on third-party rights.
Communication
Respond to queries and requests in a timely manner to avoid project delays.
Legal Compliance
Ensure your business and website content comply with all applicable laws and regulations.
Failure to meet these responsibilities may result in project delays. We are not responsible for delays caused by client non-responsiveness or failure to provide required materials.
Intellectual Property
Ownership Transfer: Upon receipt of full payment and project completion, all custom design work, code, and assets created specifically for your project become your property. You will own 100% of your website.
Portfolio Rights: We retain the right to display the completed work in our portfolio, website, social media, and promotional materials unless otherwise agreed in writing.
Third-Party Assets: Some projects may include licensed third-party assets (stock photos, fonts, icons). These remain subject to their original licensing terms and are not transferred to you.
Revisions Policy
Our $2,499 package includes a generous number of revisions to ensure you're completely satisfied with your website. Revisions must be requested within the project timeline.
What counts as a revision:
- •Changes to colors, fonts, or styling
- •Rearranging or modifying layout elements
- •Text and content updates
- •Image replacements
Major scope changes or additional features beyond the original agreement may incur additional charges and will be quoted separately.
Limitation of Liability
To the maximum extent permitted by law, Infodots Services LLP and NYC Website Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with our services.
Our total liability for any claims arising from or related to these terms or our services shall not exceed the total amount paid by you for the services in question.
We are not responsible for any loss of revenue, data, or business opportunities resulting from your use of our services or your website.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. It is your responsibility to review these terms periodically. Your continued use of our services after any changes constitutes acceptance of the modified terms.
